Work overpaid me for the last year and now wants the money back

Today I (18) was called into work for a 9-5 (I'm a casual worker in South Australia for relevance). My manager let me know that HR has been overpaying me for the last year and that I have to pay them $2,700AUD back for THEIR E

UP. No one even knew (including me) for the last year. They have a spreadsheet with proof of their f up so we know they're "not scamming me". But I'm just so irritated because well I have to pay THEM for up??

Edit: after reading the laws in my area and such. I will be paying it off in small increments with future pay cheques. BUT I will also be complaining about it whenever I feel like.

Commenters came in with some practical knowledge and advice.

ThomasofHookton Unfortunately, overpayments do happen from time to time. The company has a right to recover it but not without discussing it with you and having a written agreement. They can't for example, say they are deducting the whole $2700 from your next pay cheque.

Ask them to provide in writing; - how exactly did the over payment occur? - over how many pay periods they propose to recover it?

Review it and see if you agree. It seems pretty petty though. $2700 over a year is trivia and I would have just let it go but some companies can be super penny pinching.

TheRealSlabsy Happened to me here in the UK. I told HR that I couldn't afford to pay them back, and they took £80 a month from my wages to cover it.

sc00bs000 guy at my old work was bumped up in pay considerably for a project he was on (was only supposed to be for that project due to the company we subbed to eba, then back down to normal rate) They forgot to put his rate down for over a year.

They tried this tactic on him, pay us back or XYZ will happen. He got the union. involved, went to court and court pretty much said tough to our employer. It was a big thing around work as everyone knew about it amd was waiting to see what the outcome was.

After they lost in court employer made him sign an NDA to not tell anyone about it. He quit a few weeks after the court case. Was pretty funny

Nordic_runestone Meh it's really easy had that problem happen to me one time aswell. Just tell management or payroll people that since it's y'all's f up you're not paying a lump sum. And since it's

been a year have them just cut your paycheck by small amount each month for a year for them to get it back. Like say 2,700 divided by 12 you'll hardly notice it

kvrmatarp My dumba ex roommate did something similar but he knew they kept paying him well after he stopped working there - after about 7 months of payments he called them to fess up and "do the right thing" thinking
  • 16
they would just let him keep it or absolute worst case ask for half of it back. I told him several times just to close that bank account and move on with his life but no he just NEEDED to call and tell

them. Long story short they made him pay back all of it and he was mad they didn't just let him have 15 grand because he was so noble and honest
  • 18
ThisNiceGuy Here85 They have a right to ask for it back You have the right to ask for a payment plan that you can afford
  • 19
CaptSpazzo It happened to me. I told them I could only afford $20 a month to be taken out of my pay to pay it back.

Mabel_Waddles_BFF Legally they have to agree to a reasonable payment plan. Don't let them take it out as a lump sum. Make sure the payment plan is specified in writing and is something you can do. But if you cease employment at this

workplace they can take the remainder of the balance out of a final paycheck. Sort out a payment plan, don't to quit your job to avoid paying.
